Tony Britt

Special Counsel

Tony Britt is a dual-qualified lawyer and civil engineer with over 35 years’ experience in the construction industry. Tony’s experience includes 20 years’ experience as a civil engineer and contract manager prior to being admitted to practice as a solicitor in 2003.

Tony has in-house experience as a solicitor in private legal practice, including as a partner with a national law firm, specialising in construction and infrastructure. Tony’s engineering and construction background gives him a unique skill set and an in-depth knowledge of the industry in which he practises.

Tony has worked as a structural design engineer, project engineer, and engineering manager (BP Middle East) as a specialist contracts manager on major infrastructure projects, including for John Holland and Veolia Water Australia. Also a qualified project manager, Tony is experienced in the delivery of various types of civil infrastructure projects, including road and bridgeworks, water and waste-water infrastructure and petrochemical facilities. 

Tony has extensive knowledge and experience of all legal aspects of project delivery and project contracts. His legal knowledge and experience encompasses the entirety of the project lifecycle, from project structuring and documentation, procurement, and project delivery including contract administration and claims, to disputes and litigation.

Prior to joining Hamilton Locke, Tony worked at Morrissey Law + Advisory which merged with Hamilton Locke in 2022.  Tony is also a requested subject matter expert and is available for industry presentations, training sessions and workshops.

  • Drafting and negotiating amendments to construction contract terms for civil contractors;
  • Reviewing and negotiating dewatering and groundwater, PFAS and land decontamination contracts;
  • Drafting contracts for the demolition of significant infrastructure including Munmorah Power Station and the Sydney Harbour Master’s Tower;
  • Negotiating terms of a tender subcontract for Inland Rail PPP works;
  • Drafting and editing of Principal’s Project Requirements (PPR) for inclusion in design and construct contracts;
  • Reviewing and editing technical specifications for conformity with contract documents;
  • Successful resolution of infrastructure contract disputes at mediation;
  • Defence of security of payment claims for principals, preparation of adjudication applications for claimants;
  • Advising and assisting contractors with disputes under the contract;
  • Preparation of confidentiality deeds and deeds of settlement and release;
  • Advising a contractor on amendments to a government tender contract;
  • Drafting of pro forma suites of project documents.
