Chris Deeble

Chris specialises in financial services and credit regulation with experience from law firms, consultancy and an ombudsman.

Chris has a keen attention to detail, honed from his experience at the Credit and Investments Ombudsman (now AFCA), where he saw how a small problem can become significant. Chris applies to his work his understanding from the Ombudsman of the wide range of issues that can affect clients and their customers, how they are caused, and how they can be prevented and resolved.

In private practice, at Clayton Utz and the Fold Legal (which merged with Hamilton Locke on 1 September 2022), Chris helped clients navigate complex regulation with a focus on plain language and commercial and innovative solutions.

At KPMG Law, as well as providing legal advice on specific questions, Chris obtained an end-to-end view of the delivery of advice as well as larger projects. While on secondments and major projects, Chris learned how regulatory compliance is practically implemented and the importance of proactive problem solving and giving useful guidance.

Chris advises clients on how to meet to their regulatory obligations in relation to financial services (under the Corporations Act), consumer credit (under the National Consumer Credit Protection Act), anti-money laundering (under the AML/CTF Act), general consumer protections (under the ASIC Act), privacy and other financial services regulations.

Chris provides regulatory advice to lenders (e.g. banks, home loan providers, personal loan and credit card providers, motor vehicle financiers, buy now pay later), startups and fintechs, payment providers, carbon credit-related businesses and cryptocurrency service providers.

EXPERIENCE
  • Financial services regulation: Advising on Corporations Act obligations including licensing, disclosure documents including target market determinations, cryptocurrency tokens and services, breach reporting, responses to ASIC and regulatory change.
  • Consumer credit regulation: Advising on NCCP Act obligations including licensing for start-ups and foreign banks, conflicted remuneration for mortgage brokers, responsible lending, financial hardship, onboarding processes, credit contract terms.
  • AML/CTF: Advising on AML/CTF obligations including whether particular services have obligations, AML/CTF Programs, and the collection of customer information.
  • Remediation: Acting as the technical lead and subject matter expert on large scale remediations and designing and reviewing remediation processes.
  • Carbon credit regulation: Advising on the AML/CTF regulation of carbon credits, including for business who are generating, dealing in and using carbon credits.
  • Compliance framework review: Reviewing compliance infrastructure for gaps.
  • Privacy: Advising on privacy obligations including Privacy Policies, Privacy Collection Statements, Credit Reporting Policies, the management of personal information and responses to the OAIC.
  • General insurance: Advising on general insurance including disclosure documents.
