Katrina Emmerick

Senior Associate

Katrina is an employment lawyer with over 7 years’ experience advising on all aspects of employment law. She is recognised for her pragmatic yet empathetic approach to her work and prides herself on her ability to build strong relationships with clients. Katrina provides practical and commercial advice to her clients, tailoring her approach to meet each client’s particular business needs.

Her background includes advising clients on business restructures, performance management, terminations, workplace disputes, modern award compliance and the enforceability of post-employment restraints. Katrina also has experience working on litigious claims in the Supreme Court of NSW, the Federal Court of Australia and the Fair Work Commission. Katrina has also provided specialist support in corporate transactions, advising on key employment risks and exposures.

Katrina has worked with a number of public and private clients across a variety of sectors including professional services, technology, healthcare and support services, manufacturing and tertiary education.

Prior to joining Hamilton Locke, Katrina worked as a solicitor at DLA Piper Australia. Katrina has also worked at Johnson Winter & Slattery, Source Legal, and Danny King Legal.

SELECTED REPRESENTATIONS
  • Assisting in enforcing a 12-month post-employment restraint of trade against a former employee of an international cybersecurity company and prevented the employee from commencing employment with a competitor.
  • Represented a leading manufacturing company in defending an adverse action claim regarding bullying and harassment alleged by a former employee.
  • Advised an international power transmission company regarding Australian employment laws, including in relation to modern award application and immigration laws.
  • Conducted legal compliance audit of a national private sector client and provided advice to the Board and executive leadership team.
  • Conducted an audit of a national faith-based health and aged care organisation’s industrial instrument compliance as a result of the FWC’s Work Value Cases.
  • Instructed Counsel in the Federal Circuit Court of Australia, representing a national technology supply company against allegations of sham contracting brought by a former independent contractor, and resolved the dispute at mediation.
