Jasper is a lawyer in the Competition and Consumer team who brings a diligent, detail-focused approach to all aspects of his practice, including advising clients on the competition aspects of mergers and acquisitions. He assists clients in assessing whether a transaction is mandatorily notifiable to the Australian Competition and Consumer Commission (ACCC) under Australia’s new merger control regime, or whether notification is otherwise advisable having regard to the competition issues a transaction raises. Jasper regularly prepares notification waiver applications and formal merger notifications, and works closely with private equity and other acquisitive clients to structure acquisition strategies around the requirements of the new regime. He has experience acting on transactions in the logistics, construction, infrastructure, professional services and FMCG sectors, and is focused on providing clear, commercially grounded advice on navigating the new regime.
Beyond transactional work, Jasper advises on ACCC investigations into potential breaches of the Competition and Consumer Act 2010 (Cth), including the coordination and preparation of responses to ACCC information requests and section 155 notices. He has experience advising on cartel and other issues arising from horizontal arrangements involving competitors, such as joint ventures and information sharing arrangements, and has advised on and prepared applications for ACCC authorisation.
Jasper’s practice also extends to the Australian Consumer Law, including misleading or deceptive conduct, false or misleading representations, unconscionable conduct, consumer guarantees and unfair contract terms.
