Ben takes a pragmatic and diverse approach to his work, with a focus on providing the ‘best’ commercial outcome to resolve complex legal issues faced by his clients. His outgoing manner is at the heart of his work and interactions with clients and his wider team.

Ben is an intellectual property and technology law specialist, working extensively in the technology industry. He has extensive experience assisting clients in the technology sector, having acted for a range of individuals and companies including Fortune 100 companies, social media service providers, software developers, cloud-based solution providers and digital streaming services.

Ben also has considerable experience advising a range of clients on corporate, commercial and privacy law matters, including complex privacy impact assessments, technical and creative services contract negotiations and multifaceted commercial contract amendments.

Prior to joining Hamilton Locke, Ben worked for HWL Ebsworth Lawyers.

SELECTED REPRESENTATIONS
  • Advised a start up social media services provider on services agreements with Fortune 100 companies relating to brand promotion, content creation and account management.
  • Acted on behalf of a software developer and data scraper to prepare their suite of SaaS, hosting, development and maintenance documents.
  • Renegotiated a long term services contract on behalf of a quasi-Governmental entity to address IT, security and privacy concerns following the service provider’s move to a cloud-based solution.
  • Acted on behalf of a large, international medical mobile app provider in reviewing a EULA, data use policy, data processing agreement and licence arrangement with a UK-based service provider.
  • Prepared market entry responses for two separate international digital streaming services to assist them in understanding the Australian legal market and their obligations in conducting business here, including covering topics such as advertising, content restrictions, consumer laws, data privacy, age verification, and corporate governance.
