Monique Papas

Monique is a lawyer in the litigation and dispute resolution team with a strong background resolving a broad range of litigated and unlitigated commercial and insurance disputes. Monique takes a hands-on, thoughtful and pragmatic approach to all matters and works hard to deliver commercial and desired outcomes to her clients.

Through her committed and engaged approach, Monique enjoys building meaningful relationships with clients so that she can provide advice which is tailored to her clients’ business needs.

Prior to joining Hamilton Locke, Monique worked in the litigation and dispute resolution and insurance teams at McCabes and the insurance (casualty) team at Clyde & Co. She was also seconded as a Claims Specialist with a London-based insurer client, AXA XL.

SELECTED REPRESENTATIONS
  • Advising and acting for a major insurance company on an internal review and subsequent appeal of an ASIC decision in relation to an industry funding levy.
  • Advising former directors of a well-known company in defence of an ASIC prosecution for alleged insolvent trading and in relation to coverage issues in respect of claims for indemnity under their Directors and Officers Liability Insurance policy.
  • Acting for one of Australia’s largest commercial trade tool retailers in strategic Supreme Court proceedings against a competitor for its alleged misuse of confidential information relating to its commercial terms of trade with suppliers, and discounts, promotions and marketing strategies.
  • Alamin v Islam [2023] NSWSC 701: Acted for the defendant, Hamidul Islam in the defence of an application for mandatory injunctive relief for rectification of a settlement deed and release of a charge over shares or a declaration the deed was void ab initio by reason of mistake, successfully resulting in the application being dismissed with indemnity costs.
  • Alamin v Islam [2023] NSWCA 326 (20 December 2023) (White JA and Simpson AJA): Acted for the respondent, Hamidul Islam in the defence of an application for leave to appeal the decision of Slattery J in Alamin v Islam [2023] NSWSC 701 refusing mandatory injunctive relief, successfully resulting in the application for leave being refused with costs.
  • Tyson Ruwoldt bht Sharron France v State of New South Wales (Judgment reserved) (Harrison AsJ): Acted for the defendant, the State of NSW and instructed Senior Counsel throughout course of 9 day hearing in the Supreme Court of NSW in September and October of 2023, in relation to a claim for personal injury brought by the plaintiff in relation to injuries sustained in an assault at a State High School in 2018.”
